Cock-A-Doodle-Sue

A Kentucky man who had an inch of his penis cut off during a circumcision lost his lawsuit recently.  This was not a slip of a knife but the guy was found to have a cauliflower mass "under the hood" and without consent the surgeon lopped it off.  The pathology did show he was right as it was cancer.  He sued the doctor for $16 million because he states he was "mutilated" and "his manhood was taken".  Uh, I think the cancer did that.  In fact, he had the rest of penis taken off later by another doctor.  Ouch. The issue here, I guess, is consent.   Should the doctor stop the procedure and rebook the OR for another time (costing a lot more money) just to get consent?  Or should he be penalized for doing something that wasn't an actual emergency?  The last point is valid and gets very technical.  Seems to me more and more paperwork is on the way for future surgeons no matter how this case ended or the appeal turns out.  Got to love lawyers.
